Arrest of Judges: Melaye faults Presidency, says DSS acted outside its mandate

Read the statement below
Although there is need to rid the judiciary of corruption, the approach adopted by President Muhammadu Buhari was totally wrong and unacceptable, the Chairman, Senate Committee on the Federal Capital Territory (FCT), Otunba Dino Melaye, said on Sunday.
Melaye, representing Kogi West on the platform of the All Progressives Congress (APC) in the National Assembly, in a statement he issued in Abuja, condemned the arrest and invasion of the residence of some Judges by the Department of State Services, saying the agency acted outside its core mandate.

According to him, although Judges have no immunity and could be tried, the use of DSS by government was "absolutely wrong and unacceptable."

He said, "I have studied the Act setting up DSS, Nigerian Intelligence Agency and DIA  and can conclude that the DSS operatives went outside their core mandate. There is no doubt that many Judges are corrupt. It is also important to state the need to sanitise the judiciary of corruption that make Judges not to give commercial rulings which create terrible precedence in our legal system. Judges have no immunity and can be tried and should be tried but the use of DSS is absolutely wrong. 

"The DSS operatives even when they overstretched themselves and conducted investigations on the Judges. They ought to hand over their findings to the appropriate institutions of government: the Police or National Judicial Council for prosecution and punishment. 

"The rule of law is a core value of governance and therefore must be guided jealousy. Prosecution of civil and corruption cases in not the responsibility of DSS. Internal security is the main duty of the DSS and they should stick to that. God bless the Federal Republic of Nigeria."

Gun-wielding DSS and police operatives had on Friday night and in the early hours of Saturday swooped on the residences of senior judges, breaking doors and threatening to harm their family members and aides.

The Judges affected in the raids carried out in Abuja, Port Harcourt and Gombe States 
were of the Supreme Court and Federal High Court. 

At least two of the Justices were said to have recently ruled against the DSS and condemned its disregard of the laws of the land during its operations.
They arrested Judges are Justice Sylvester Ngwuta (Supreme Court); Justice John Okoro (Supreme Court) and Justice Adeniyi Ademola of the Federal High Court in Abuja.
The DSS also searched the residence of another judge of the Federal High Court, Justice Nnamdi Dimgba, but he was not arrested.

Intrestingly almost everybody agrees that the Judges have a case to answer, opinion however differ on the manner of arrest. But everybody is the same before the law and daily we see and hear about how people are picked in different circumstances. If indeed we are same under the law of the federal Republic and we did not complain when others were picked, why are you worried about the Judges?

Its obvious Mr Melaye does not understand the National Security Agencies Act which established the DIA, NIA and the SSS. Mr Melaye, how do you interpret this quotation from the act -

"such other responsibilities affecting internal security within Nigeria as the National Assembly or the President, as the case may be, may deem necessary"

Dino, Corruption is a threat to our existence as a nation. So from the act if Mr President ask the SSS/DSS to investigate and apprehend corrupt Judges, there is nothing wrong with such.

There is procedures for every trial. Military have their own procedure . Let poverty and recession caused by pmb not be cloud ur small sense. Are you going to try them in Dss tribunal or the same judiciary you are disorganizing. Or u will bring hausa Fulani to preside over the courts or Dss tribunal. What we are saying is that you don't disorganize an existing good policy of trial laid down by NBA bc you are failing thereby sending a wrong signal to the outside world thereby pursuing out the little no of investors left here.

First, a petition must be sent to the NJC who's duty is to investigate and send recommendations to the governor or president, depending on the court, thereafter criminal proceedings can be instituted against the judge/ justice. I believe those procedures are in place to prevent acts of anarchy like what just took place. The judiciary has the onerous and unenviable role of interpreting the laws and protecting the rights of citizens, from time immemorial it has been the final hope of the common man, therefore saying that it MUST be independent is an understatement. This is no dictatorship where the major institutions of governance are often gagged. No one can fight Illegality with Illegality.

A case where you can, essentially, buy any verdict from corrupt judges. Appallingly, I see there are MANY people against the public humiliation of these men who are supposed to be the last bastion of anything well organized in Nigeria. Bearing in mind that the consensus is that Nigeria is a VERY Corrupt and disorganized country and we would like to at least reach some semblance of organization (talk less of reducing the corruption), I feel like these Judges are our last hope of maintaining any form of sanity. Hence, they should be held to higher moral/ ethical standards (as it is done in other better organized countries that we strive to emulate, I must add). There should never be any doubt of neutrality in the prosecution of the rule of law. My people, in order to prevent this country from imploding, which by the way we are dangerously close to, the judicial system should be the completely clean of any corruption.
NOBODY, and I stress NOBODY, should be above the law.

If one is suspected to have stashes of cocaine in the house will the security operatives wait for a day in court or will they obtain search warrant and go in first? You want to wait for a day in court and say he should go and bring the cocaine in his house to court? Obtain search warrant, be as civil and respectable as possible.

So if you have an incriminating evidence in somebody's house, you will go to court first and tell the person to bring the evidence? And you think the person will own up and bring the evidence?
