Charge Metuh to court if you have evidence of fraud against him, Fayose tells Buhari

Ekiti State Governor, Mr Ayodele Fayose has challenged President Mohammadu Buhari to direct the Economic and Financial Crimes Commission (EFCC) to charge the Peoples Democratic Party (PDP) National Publicity Secretary, Chief Olisa Metuh to court if the commission was sure of evidences of fraud against him, saying; “the EFCC appears to be operating a system in which an accused person is
first arrested, detained endlessly while the anti-corruption agency goes about looking for evidence.”
Governor Fayose, who maintained his support for a genuine fight against corruption, challenged the EFCC to also act on petitions submitted to it against All Progressives Congress (APC) chieftains and President Buhari’s election sponsors.
Speaking through his Special Assistant on Public Communications and New Media, Lere Olayinka, Governor Fayose cautioned that nothing untoward must happen to Metuh, adding that the APC’s desperation to decimate and silence the opposition has dragged the Buhari-led government in the mud of lawlessness.
The governor said; “In saner climes, you don’t arrest people for alleged fraud and start to look for evidence to prosecute them. Rather, before you arrest anyone for fraud, anti-corruption agencies
must have established a prima facie case and arresting the suspect will only be to enable for his or her arraignment in court.
“However, what we are witnessing in Nigeria today is a situation whereby the EFCC will arrest PDP leaders, humiliate them by subjecting them to media trial, detain them for weeks in the process of trying to force them to make statements during which the commission will be looking for evidence.
“For instance, in the case of Metuh, we are being told that the EFCC is insisting that he must write statements and one begins to wonder if it has now become mandatory for an accused to write statements in law enforcement agent’s custody. Shouldn’t the EFCC have simply charged Metuh to court based on its own evidence? Or is Metuh’s statement the evidence the EFCC requires to prosecute him?
“The international community, especially the United Nations (UN), African Union (AU), European Union (EU) and others are put on notice on this condemnable act of arresting and detaining opposition leaders by agents of the Buhari-led government before fishing for evidence.”
While challenging the President Buhari to extend his anti-corruption crusade to those who sponsored his election, Governor Fayose said; any anti-corruption effort that targets only members of the opposition and those with axe to grind with the government of the day can never succeed.
“If President Buhari did not wait for any petition to move against PDP chieftains, asking people to come forward with allegations of corruption against APC chieftains, especially those who sponsored President Buhari’s election is clearly hypocritical.
“Most importantly, that the EFCC Acting Chairman, Ibrahim Magu even said the commission do not have any petition against APC chieftains when indeed there are loads of petitions against ministers serving in Buhari’s government and other notable APC chieftains goes to show the hypocrisy of the fight against corruption.
“It is even more hypocritical and anti-democratic for the President to have turned himself to the accuser, prosecutor and judge, carrying on as if those he accused of corruption have already been convicted,” the governor said.

its pathetic the situations and happenings in the country,One thing we miss about the YARDUA days is the respect for the rule of law,we had a president who respected rule of law..Nobody is against fighting corruption,if METUH is found guilty charge him to court,it was alledged that N1.4 billion was found in his business account,clearly this is false as only N400 million was found in the account..400 million naira for a SERIOUS business man as Metuh,definitely u know him having that large amount in his account is very feasible..FAYOSE is js reminding the president about not setting bad preceedents as we can witness with the blatant disregard for rule of law.

its very dishearting the high level of impunity in the country currently,when Nigerians voted in the APC administration we expected a lot of things done during the military era which included some of the happenings now not to occur,but with the case of Nnamdi Kanu,Sambo Dasuki we knew the era of impunity has returned,if OLISA METUH is guilty charged him to court, not keeping him in detention more than the 48 hours required by law to either charge or release if nothing is found against anyone.

Truth be told, the same measures in the fight against corruption should be applied across board, party affiliations regardless. If PDP chieftains could be picked up on alleged suspicion of corruption, how about some chieftains in the folds of APC? How many chieftains in the APC fold have we read that were 'invited by these anti-graft agency'or are they implying by this inaction that all APC chieftains are saints. From every indication it is glaring that EFCC is bias, not straight forward, not representing the nation the way it should be, in fact, the purpose of the institution is defeated been the fact that they are only working on speculations. They are not factual, publishing one figure today, tomorrow they publish another.Today they will tell Nigerian's olisa metuh was accused of #1.4bn, next time they will tell us is #4bn.Very uncertain, just dancing to the tune of the presidency.
Lia Mohammed was once also in the shoes of Olisa Metuh, he was the money bag of APC during the presidential campaign various money where sent to his account by his party to carry out the party obligation- his account should be checked.The same played with olisa Metuh, the money given to him by his party was disposed accordingly and he is been accused of corruption. if that be the case Lia Mohammed should also be arrested by EFCC for corruption and detained.

I am not a fan of any Nigerian politician including Fayose's, but you don't have to be an attorney to understand Fayose's statement. It is not done in advanced countries to arrest before searching for evidence. You have to have obvious evidence before executing arrest. I don't understand legal professionals in Nigeria relying on petition in their prosecution. I am very much in favor of jailing those that have looted our treasury at least 10 years imprisonment but based on facts not petitions from your enemies. God bless Nigeria

Anyone that condenms the anti corruption war regardless of how it is executed is an enemy of progress. This country is been infested with corruption for so long. I think we should all stand behind this present administration. Some say this is witch hunting but the obvious truth is that the ones arrested so far are witches that had sucked off Nalso just that they mostly from another political party. But how does this remove the fact that they are guilty? Should they be overlooked because of what the like of Fayose will say? If my honourable governor supports his people,to a reasonable extent, I understand because he must have eaten from the forbidden apple also but we the poor citizens that had been the victim of corruption wrapped in selfishness, I think it is insanity. Let us join hand with this administration to tackle corruption. Who knows things may just get better..

efcc is controled by buhari just like judiciary is controled by him. Disobeying court is democracy ok, only in a zoo country like nigeria this kind of thing happens. The world are watching him, clamping down on opposition members is not in buhari, he did in 1983 and he is repeating it again in 2015.

A system in which a citizen is arreested, detained and subjected to media trial clearly shows the incompetence been displayed by the EFCC and our law enforncement. It is a proof that they are not operating in the powers confered on them but rather been tossed like a donkey by the current administration. The time has come when Nigerians must stand to their rights. Forceful leadership can never be an option for us

Holding Charge which implies ‘arrest before investigation’ instead of ‘investigation before arrest’ is clearly an aberration and abuse of judicial process which has since been declared by several courts as illegal, null and void, and of no effect as it is totally in contradiction with section 35 (1), (4), (5a) of the constitution of the Federal Republic of Nigeria.We draw the attention of all Nigerians and the international community to this illegal clamp-down on the opposition spokesman by the EFCC.

‘investigation before arrest’ ‘ instead of arrest before investigation’ is indeed clearly totally in contradiction with section 35 (1), (4), (5a) of the constitution of the Federal Republic of Nigeria.......since its widely and well know by common Nigerians talk more of politicians.... then dis simply indicates that we are in a lawless government and something have to be done before it get out of hands... also from the statement “The public is very much aware that the EFCC Chairman has visited the Presidential villa at least twice since Chief Metuh was arrested and detained by the commission, ostensibly to get further directives on the case....Mehn is so obvious that we really really need the international community to intervene......before dis dictator government will lead to something else.....
